Understanding Controlled Drugs Licensing 2026

What Wholesalers & Wholesaling Pharmacies of Controlled Drugs Must Know 

Holders of a Wholesale Distribution Authorisation (WDA) must abide by a range of complex regulatory landscape.
If you supply medicines, in particular, controlled drugs in Schedules 2-5, there are dual obligations you must satisfy under UK law. First, you need an MHRA Wholesale Distribution Authorisation (WDA(H)), and second, a Controlled Drugs Licence from the Home Office.  

Many of our clients ask how both licences interrelate, what the current requirements are, how long it takes, and how much it costs. This post brings the regulated landscape up to date and updates our earlier blog from 2016 to reflect changes in procedure, costs and expectations. 

Why Two Licences? 

• WDA(H) (Wholesale Distribution Authorisation for Human medicines) is issued by the MHRA and is required for the storage, distribution, and supply of medicines to entities other than direct to patient. It demands compliance with EU Good Distribution Practice (GDP) Guidelines 2013/C 343/01, the Human Medicines Regulations 2012 as amended, and the expectations of the MHRA. The specific category of product required would be under 3. Medicinal Products with Additional Requirements, specifically “3.1.1 – Narcotic and Psychotropic.”

• A Home Office Domestic Controlled Drugs Licence is needed when those supplies include Controlled Drugs (CDs), particularly Schedules 2-5 under the Misuse of Drugs Regulations. This licence grants legal authorisation for possessing, supplying, producing or offering to supply controlled substances. It is separate, with its own set of rules, visits, named persons, security requirements, and costs.  

A wholesaling pharmacy or pharmaceutical wholesale distributor must ensure both licences are in place if the distribution of controlled drugs is part of the business. Failure to do so risks serious legal, financial and reputational consequences. 

What the Current Procedures Look Like (2026)

Here’s a step-by-step of what you need to do, what’s checked, and what to expect in processing times etc.: 

Step	Key Tasks & Checks
Application	Register with the Home Office Drugs & Firearms Licensing Unit (DFLU) via its controlled drugs licensing portal. Provide all required documentation, named personnel etc.
Named Roles	You must name key roles, including the Person in Charge, Person in Charge of Security, Authorised Witness and Site Responsible Person. All named persons need valid Enhanced DBS that is specifically processed through Matrix Security Watchdog (part of Capita PLC). If you do not use this service, you will have your application rejected.
License Readiness	Compliance visits are required for first-time applications, new sites, or substantial changes. The visit will review your standard operating procedures (SOPs), security of premises, records, and other documentation. You must comply with the Home Office’s General Security Guidance and if transporting CDs, the transport security guidance.
Application Timing	Your application must be submitted with all required information to be considered ‘valid’. Once valid, the Home Office aims to contact you within 16 weeks to arrange a compliance visit (where required).
Renewal & Changes	Licences have defined durations. Renewal applications should be made sufficiently ahead of expiry: when no visit is required, earlier; when a visit is likely or required, longer. Also, changes of address, legal entity etc. must be reported and variation applied for.

 

Fees & Costs (2026 Figures) 

Arguably one of the most important sections for planning and budgeting. Here are the current fees as published by the Home Office:

 Renewal fees (for an existing controlled drugs domestic licence):

 

• If no compliance visit is required: £326  
• If a visit is required: £1,371  

How WDA(H) & Controlled Drugs Licence Fit Together 

Here are some of the key intersections between the two licences that often cause confusion — and what you need to check carefully:

 

• A WDA(H) licence from the MHRA may include, among its product activity classes, the ability to deal with “narcotic/psychotropic / controlled drug products”, but that alone is not enough to supply or hold controlled drugs legally. The Home Office licence must explicitly cover the relevant schedules and activities (possession / supply / production).  

• Wholesaling pharmacies: If you are both a retail pharmacy and doing wholesale dealing (supplying stock), you must hold a WDA(H). If the stock supplied includes controlled drugs, you will also need the Home Office controlled drugs licence. Supplying Doctors via “requisition” is an exemption that disappeared in 2012 with the update to the Human Medicines Regulations.

• Gap analysis: Check if your current licenses cover all activities you do, especially controlled drug schedules, supply vs production, etc. If not, plan for obtaining or varying the licences. 

• Personnel & DBS: Ensure that all the named roles are clear and documented, with signed job descriptions, that those individuals have valid Enhanced DBS checks via Home Office-approved route, and records are maintained. Delays or not using the approved DBS provider will often hold up applications.

• Premises, SOPs & Security: Prepare your site(s), SOPs, records, and transport arrangements (if relevant) in advance of application. Having these well-documented and in compliance with Home Office security guidance improves chances of smoother inspector feedback. 

• Budget & Timeline: Budget not only for licence fees but also internal preparation costs, for example, modifying premises, training and documentation, plus anticipate at least 3-6 months from start to getting the licence, depending on completeness of application. Of late, we have seen even renewals extending way past 4 months, and new applications up to a year! 

• Review and Renew Early: As renewal can involve compliance visits and risk-based inspections, schedule renewals well in advance of expiry to avoid lapses. Whilst waiting for the new licence it is typically accepted that confirmation of the Home Office visit or approval can be used in the interim. Give the Home Office as much notice as possible, as it is frequently extending beyond 4 months on renewal.

• It ensures the ability to respond to inspections or audits without costly remediation or operational interruption.
